Curionica – Terms of Service

Effective date: August 24, 2025

Curionica (“we”, “our”, “us”) is an iOS/iPad app that helps preschool-aged children explore everyday objects through images, short descriptions, and audio narration. These Terms govern your access to and use of Curionica.

By downloading, installing, accessing, or using Curionica, you agree to these Terms. If you do not agree, do not use the app.

1. Eligibility & Parental/Guardian Responsibility

  • Curionica is designed for children ages 3–6 to use together with a parent or legal guardian.
  • A parent or legal guardian must purchase and manage the app and any subscriptions.
  • You are responsible for ensuring that children use the app safely and appropriately.

2. Accounts, Access & Purchases

  • Curionica does not require user accounts. Purchases and subscriptions are handled solely through the Apple App Store using your Apple ID.
  • You must comply with Apple’s terms and policies when obtaining Curionica.

3. Subscriptions, Trials, Billing & Refunds

  • Curionica may offer auto‑renewable subscriptions. If available, free trials are provided as indicated in the App Store listing.
  • Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel subscriptions in your Apple ID account settings. Deleting the app does not cancel your subscription.
  • Refunds are governed by Apple’s standard refund policies; requests must be made through Apple.

4. License to Use Curionica

Subject to these Terms, we grant you a personal, limited, non‑exclusive, non‑transferable, revocable license to download and use Curionica for personal, non‑commercial purposes on Apple devices you own or control. We reserve all rights not expressly granted.

5. Prohibited Uses

You agree not to:

  1. Copy, modify, translate, adapt, or create derivative works from the app or its content;
  2. Reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law;
  3. Use the app for unlawful, harmful, or fraudulent activity;
  4. Circumvent security, access controls, or technical restrictions;
  5. Resell, sublicense, rent, or otherwise commercially exploit the app or content;
  6. Upload, transmit, or introduce malware or other harmful code.

6. Content & Intellectual Property

Curionica and all content therein (including text, images, audio, UI, features, and underlying code) are owned by RapidLabs, LLC or its licensors and are protected by intellectual property laws. No rights are granted except as stated in the license above. All trademarks, logos, and service marks are the property of their respective owners.

7. Feedback

If you send ideas, suggestions, or feedback, you grant RapidLabs, LLC a worldwide, perpetual, irrevocable, royalty‑free, sublicensable and transferable license to use, copy, modify, create derivative works from, and otherwise exploit such feedback for any purpose, without compensation to you.

8. Third‑Party Services (Analytics & Crash Reporting)

Curionica functions fully offline for core features and does not require user accounts or internet connectivity for normal use. However, we may use third‑party services such as analytics and crash reporting to improve reliability and quality (e.g., Firebase Analytics, Firebase Crashlytics, Mixpanel). These services may process limited technical data as described in our Privacy Policy. We do not use data for targeted advertising.

9. Safety & Educational Disclaimer

Curionica provides educational content for children but is not a substitute for parental supervision, professional advice, or formal education. Parents/guardians should guide how children use the app and assess suitability of content for their child.

10. Disclaimers of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR‑FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL RAPIDLABS, LLC OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP OR, IF GREATER, FIFTY U.S. DOLLARS ($50).

12. Indemnification

You agree to defend, indemnify, and hold harmless RapidLabs, LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of Curionica or violation of these Terms.

13. Termination

We may suspend or terminate access to Curionica at any time, including for violations of these Terms. Upon termination, the license granted to you will automatically terminate.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming, for any disputes arising from or relating to these Terms or the app, except where applicable law provides otherwise.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms in the app and on our website and update the Effective date above. Your continued use of Curionica after changes take effect constitutes acceptance of the updated Terms.
